These Terms & Conditions (the “Terms”) are a contract between you and Silver Footfalls (“we”, “us”, “our”), the operator of the website at silverfootfalls.com (the “Site”). We are based in Scotland, United Kingdom. By accessing or using the Site you agree to these Terms. If you do not agree, you must not use the Site.
1. What Silver Footfalls is
Silver Footfalls publishes fiction stories in audio and written form, generated with the assistance of artificial intelligence. The Site is open to everyone. Some stories are sexually explicit and intended for adults only; where they are, we place them behind an age check (see section 2). All of the content is fiction. It does not feature real performers, and every character depicted in a sexual context is a fictional adult aged 18 or over. See our Content & AI Statement for detail.
2. Adult content and age checks
The Site is open to everyone. Some content is sexually explicit and is for adults only. You may only access, buy, or use that adult content if you are aged 18 or over and it is lawful for you to view sexually explicit material where you are located.
Where the Site offers sexually explicit content, we use age assurance to confirm that users are adults before they can view that content, and we may ask you to verify again. Confirming your age is a condition of accessing adult content. How this works, and what data is involved, is explained in our Age Verification policy.
3. Your account
You create an account with an email address and a password. You are responsible for keeping your password secure and for activity that happens under your account on the Site. Tell us at admin@silverfootfalls.com if you think your account has been used without your permission. We may suspend or close accounts that break these Terms, our Acceptable Use Policy, or the law.
4. Buying content
Content is sold as one-off purchases at the prices shown on the Site (in £ GBP). There are no subscriptions. When you buy a story or chapter, we record the purchase against your account so you can access it. A purchase gives you the licence described in section 6 — you are buying access to content, not the content itself.
Payment is handled by our third-party payment provider. We do not receive or store your full card number or security code — those go directly to the payment provider. We receive confirmation that a payment succeeded and a reference. Your use of the payment provider is also subject to that provider’s own terms.
5. Price and confirmation
Prices are shown before you pay. The contract for a purchase is formed when we confirm your order and access is granted.
6. Your licence to the content
All stories, audio, text, images and other material on the Site are owned by Silver Footfalls or our licensors and are protected by copyright and other rights.
When you buy content you receive a personal, non-exclusive, non-transferable, revocable licence to stream and privately enjoy that content for your own non-commercial use, for as long as we make it available. You must not:
- copy, download (beyond ordinary streaming/caching), reproduce, or redistribute the content;
- share, resell, sub-licence, rent, lend, or make the content available to anyone else;
- share your account or your access with anyone else;
- remove or circumvent any access control, watermark, or security measure;
- scrape, crawl, or systematically extract content from the Site; or
- use any content, in whole or in part, to train, fine-tune, or develop any AI or machine-learning model, or for text or data mining, without our prior written permission.
These rules are set out in full in our Acceptable Use Policy, which forms part of these Terms.
7. Refunds and your right to cancel
Our content is digital and is made available to you immediately after purchase. Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have 14 days to cancel a distance purchase — but for digital content that right is lost once supply has begun with your agreement.
At checkout you agree that we may give you immediate access to the content, and you acknowledge that by doing so you lose your 14-day right to cancel. Once you have that access, the purchase is non-refundable, except where the law gives you a refund — for example if the content is faulty, not as described, or not of satisfactory quality under the Consumer Rights Act 2015. Nothing in these Terms affects those statutory rights.
8. Acceptable use
You must use the Site lawfully and in line with our Acceptable Use Policy. In short: don’t break the law, don’t share or resell what you buy, don’t attack or abuse the Site, and don’t access the adult content if you are under 18.
9. Content disclaimer
Everything on the Site is fiction created for entertainment. Stories, characters, names, and events are imaginary; any resemblance to real people or events is coincidental. The content is not advice of any kind and does not depict real people or real events. Content is provided for your enjoyment only.
10. The Site is provided “as is”
We provide the Site with reasonable care and skill, but to the extent the law allows we make no warranties that the Site will be uninterrupted, error-free, or always available. We may change, suspend, or withdraw the Site or any content at any time. Where we permanently remove content you have paid for, we will try to give reasonable notice and offer a fair remedy.
11. Our liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, to the fullest extent permitted by law we are not liable for any indirect or consequential loss, and our total liability to you arising from your use of the Site or any purchase is limited to the amount you paid to us in the 12 months before the claim. This does not affect your statutory rights as a consumer.
12. Suspension and termination
We may suspend or end your access to the Site or to purchased content if you seriously or repeatedly break these Terms or the Acceptable Use Policy, if required by law, or to protect the Site or other users. Where it is fair to do so, we will tell you why.
13. Changes to these Terms
We may update these Terms from time to time. The “last updated” date shows when. For significant changes we will take reasonable steps to tell you. Continuing to use the Site after changes take effect means you accept the updated Terms.
14. Governing law and disputes
These Terms and any dispute arising from them or from your use of the Site are governed by the law of Scotland, and you and we submit to the non-exclusive jurisdiction of the Scottish courts. If you are a consumer living elsewhere in the UK or in the EU, you keep the benefit of any mandatory consumer protections that the law of your home country guarantees.
